The Scotch® Brand Most Gifted Wrapper Contest Rules

  1. NO PURCHASE NECESSARY. A purchase will not improve your chances of winning. The Scotch® Brand Most Gifted Wrapper Contest (the “Contest”) is sponsored by 3M Stationery Products Division (“Sponsor”). The Contest begins at 10:00 AM Eastern Daylight Time (EDT) July 6, 2011, and ends at 11:59 PM Eastern Daylight Time (EDT) October 3, 2011 (the “Contest Period”). CONTEST VOID IN ALASKA AND HAWAII AND WHERE PROHIBITED BY LAW. Odds of winning depend on the number of eligible entries received. Sponsor’s computer is the official time-keeping device for the Contest.
  2. ELIGIBILITY: Nominators: To be eligible to nominate yourself or someone else, you must be age 21 or older on July 6, 2011, and a legal U.S. resident residing in one of the 48 contiguous United States or Washington, D.C.

    Nominees: To be eligible, nominees must be legal U.S. residents residing in one of the 48 contiguous United States or Washington, D.C., and age 21 and older, as of July 6, 2011. Both professional gift wrappers (i.e. those who are currently employed as or have previously earned income as gift wrappers at department stores, specialty stores, etc.) and amateur gift wrappers (i.e. those with no employment experience as gift wrappers) are eligible to participate. Nominees who have never earned income as professional gift wrappers but have served as unpaid gift wrapping volunteers at shopping malls, charitable events, etc. are considered amateurs for this Contest. Nominees who wrap or have wrapped gifts for an employer, but for whom gift-wrapping is not the nominees’ primary job responsibility, will also be considered amateurs for this Contest. Employees of Sponsor, its affiliates, subsidiaries, advertising and promotion agencies — including, without limitation, those involved in the administration, execution and judging of the Contest — and their immediate families (parents, children, siblings, spouse) and members of their same households (whether related or not) are not eligible to enter, either as a nominator or a nominee. All past contestants who competed in any of the previous Scotch® Brand Most Gifted Wrapperfinals are not eligible to participate.

    Entrants selected as contestants for the finals of the Contest (the “Finals”) must be able to travel to New York City between December 1, 2011, through and including December 4, 2011. If an entrant is selected as a contestant for the Finals and cannot travel during this time, he or she will be disqualified and an alternate contestant may be selected.

  3. HOW TO ENTER: During the Contest Period, to enter the Contest, a prospective nominator must go online to www.mostgiftedwrapper.com (“Site”) and accurately and truthfully complete all mandatory elements of the Official Entry Form, including, but not limited to:

    • a) Nominator’s complete name, company/place of employment (if applicable), home address, city, state, zip code, daytime telephone number, and e-mail address; b) Nominee’s complete name, company(ies) in which the nominee has previously wrapped or is currently wrapping gifts (if applicable), home address, city, state, zip code, daytime telephone number, and e-mail address (this information will only be used with respect to the Contest and to provide you with information about Sponsor products in accordance with Sponsor’s privacy policy found at www.3m.com/privacy.jhtml.);
    • An essay of 100 words or less, describing why you believe you or the individual you are nominating has the gift-wrapping skills it takes to participate in the Contest;
    • In 30 words or less, provide nominee’s best tip for gift wrapping. If prospective nominator is nominating someone other than him/herself, tip should be the best gift-wrapping tip nominator has learned from nominee; and
    • Specify whether the nominee is a professional or an amateur gift wrapper.
      (collectively, the above materials referred to in these Official Rules individually as an “Entry”; collectively, as “Entries”).

    While not a condition of entry into the Contest, nominators are encouraged to submit photographs (no more than two) that demonstrate the nominee’s skill in the area of gift wrapping. Photographs must be GIF, JPG or BMP format and each photograph must not exceed 1MB. If submitted, photographs will become part of Entries except where these Official Rules expressly state otherwise.

    Limit one entry per nominator. Entries cannot be revised or altered once submitted. Neither Sponsor nor its agents will be responsible for technical malfunctions, inability to access the Site or for lost, late, scrambled, jumbled, destroyed, delayed, misaddressed or otherwise misdirected, mutilated, stolen, or delayed Entries and neither Sponsor nor its agents assumes responsibility for any error, omission, interruption, deletion, defect, delays in operation or transmission, theft or destruction or unauthorized access to, or alteration of, Entries. No incoherent, unoriginal, illegible, inaccurate or incomplete Entries will be accepted, and Sponsor reserves the right to reject or disqualify any Entries that it deems inappropriate, in its sole and absolute discretion, including for references to violence, sex, illegal or inappropriate activity. Neither Sponsor nor its agents will be responsible for any problems or technical malfunctions of any telephone network or telephone lines, computer on-line systems, servers or providers, computer equipment, software, failures in transmission of Entries or other problems (whether due to technical problems, human error or traffic congestion (or any combination thereof)), including any injury or damage to a person's computer arising out of, relating to or resulting from this Contest. Confirmation of receipt of Entries will not be provided.

    Submission of Entries grants Sponsor and its agents the right to publish, use, edit, adapt, modify and/or exploit such Entries, or any portion thereof, in any way, in any and all media, whether now known or hereafter developed, without limitation and without notice, compensation or other consideration (except where prohibited by law), and constitutes the irrevocable assignment and transfer to Sponsor of any and all right, title and interest in and to such Entries, including, without limitation, all copyrights and any renewals and extensions thereof. Upon Sponsor’s request, entrants will execute any documents necessary to effectuate such ownership.

  4. JUDGING: Eight contestants — four amateurs and four professionals, as defined in Section 2 of these Official Rules — will be selected from all eligible Entries to participate in the Finals, scheduled to take place in New York City on or about Friday, December 2, 2011. The eight contestants will be selected no later than October 24, 2011 by an independent panel of judges whose decisions are final. Entries will be judged on two criteria: (1) persuasiveness of the recommendation (50%) and (2) entrant’s experience and creativity in wrapping gifts (50%). The eight contestants will be notified via phone, e-mail or Federal Express on or around October 29, 2011. Each contestant must sign and return any required Affidavit of Eligibility/Release of Liability and Publicity within five (5) days of delivery to such contestant’s address as identified on the Official Entry Form (“Contestant’s Address”). Non-compliance within this time period will result in disqualification and the possible selection of an alternate contestant. Each contestant will also be sent a Flip-Video Camera (“Camera”) and asked to create a three (3) minute video (“Video”) of him/herself showing his/her favorite gift-wrapping techniques. Each contestant must e-mail the Video he/she creates to Hunter Public Relations (“Hunter PR”) within five (5) days of delivery of the Camera to Contestant’s Address in accordance with the directions provided. Non-compliance within this time period will result in disqualification and the possible selection of an alternate contestant. Videos will become part of Entries. Each Contestant must also return the Camera to Hunter PR within seven (7) days of delivery to Contestant’s Address. Any notification returned to Sponsor as undeliverable will result in disqualification and the possible selection of an alternate contestant.

    All contestants must be willing to make media appearances on behalf of Sponsor, prior to, during and after the Finals.

    The Finals consists of three rounds, with qualifying finalists in each round individually wrapping an identical item(s). Contestants in each round will be judged on two criteria: (1) appearance of packages wrapped (70%) and (2) technique (30%). In the event of a tie, speed will serve as the tie-breaker. All contestants will be required to use Scotch® transparent tape and other Scotch® brand products.

    Decisions of the judges are final in all matters relating to the Contest and are not subject to review or appeal.  Selection of the Grand Prize Winner will be announced at the end of the Finals as well as announced via a national press release after the selection.  All federal, state, and local laws and regulations apply.  Without limiting anything set out in these Official Rules, acceptance of prizes constitutes permission to use each contestant’s name, image/ likeness, photograph, voice and/or biographical material in advertising and promotional activities without notice, compensation or other consideration (except where prohibited by law).

  5. PRIZES: One (1) Grand Prize: $10,000 check made payable to the Grand Prize winner.  Seven (7) runners-up prizes worth a total of $4,500, allocated as follows:

    • $2,500 for the Round Three finalist..
    • A $500 American Express® Gift Card for each of the two (2) Round Two finalists.
    • A $250 American Express® Gift Card for each of the four (4) Round One finalists.

    One (1) Nominator Prize (to be awarded only if the Grand Prize winner is not self-nominated): $1,000 check made payable to the person who nominated the Grand Prize Winner. If more than one person nominated the Grand Prize winner, the person who first submitted the nomination will be eligible to win the $1,000 nominator prize.

    In addition to the above, each of the eight (8) contestants will receive a round trip coach class airline ticket for one to New York City on or around Thursday, December 1, 2011, to participate in the Finals, departing from the major commercial airport nearest the contestant’s home and utilizing Sponsor's carrier of choice. Stopover trips are not allowed. Standard single room accommodations for 3 days/3 nights will be provided by Sponsor at Sponsor’s hotel of choice. Sponsor will reimburse each contestant for the purchase of meals while in New York City for the Finals in an amount not to exceed two hundred dollars ($200), provided that appropriate receipts documenting the amounts spent are received by Hunter PR no later than January 2, 2012. Arranging ground transportation to and from each contestant's home and the airport, to and from the airport and hotel, and from hotel back to the airport, will be the responsibility of the contestants, but Sponsor will reimburse each contestant for the actual transportation costs incurred in an amount not to exceed two hundred dollars ($200), provided that appropriate receipts documenting the amounts spent are received by Hunter PR no later than January 2, 2012. Transportation to Finals-related activities in New York City will be provided to each contestant. Each contestant is solely responsible for all expenses, costs and fees associated with attendance at the Finals and/or acceptance of a prize not specified herein as being provided, including, without limitation, any and all taxes, gratuities, and personal purchases/souvenirs. Each contestant shall cooperate with Sponsor with respect to any applicable federal, state or local tax reporting requirements related to the prizes or other consideration received by the contestant. Each contestant is solely responsible for reporting and paying any and all applicable federal, state and local taxes and any additional fees associated with prizes.

    Approximate retail value (“ARV”) of each contestant prize package (including the travel and meal expenses set out above) is between $1,950 and $11,700, depending on whether a contestant is the Grand Prize winner or a Round Three, Round Two or Round One semi-finalist.Total ARV of all prizes is $29,100 ($28,100 if the Grand Prize winner is self-nominated).

    Sponsor reserves the right, in its sole discretion, to substitute a prize or prizes of equal or greater value for any and all prizes. No other substitutions, cash equivalents or transfer of prizes allowed unless specifically authorized by Sponsor. All properly claimed prizes will be awarded.

  6. GENERAL CONDITIONS: This Contest is governed by the laws of the State of New York. By participating in the Contest, entrants agree (1) to be bound by and abide by these Official Rules and by all decisions of Sponsor, whose decisions are final and not subject to appeal; (2) on behalf of themselves, their executors, heirs and assigns, to release and hold Sponsor, Hunter PR and its and their respective directors, officers, employees, subsidiaries, affiliates, agents, employees, suppliers, divisions, agencies, licensors and advertising, promotional, or judging agencies, and any and all prize suppliers (“Released Parties”), harmless from any and all causes of action, liabilities, losses, harm, damages, injuries, costs, expenses, suits, cross-claims or counterclaims, or any other claims arising out of or relating to such entrant’s participation in the Contest, whether or not arising from the negligence of aNY released parties, including but not limited to property damage, personal injury and/or death, any injury or damage to entrant’s or any other person’s computer relating to or resulting from participating in the Contest or downloading any materials related to the Contest, third party claims that may be made against entrant and/or any of the Released Parties, including without limitation, those based on defamation, violation or infringement of a third party’s publicity rights, right of privacy, copyright, trademark or other proprietary right and claims arising out of or relating to acceptance, receipt, possession or use/misuse of any prize (or while preparing for, participating in or traveling to and/or from any prize-related activity or otherwise), or any publicity or other public exposure of the entrant, or acts undertaken in preparation for or participation in the Contest; (3) to assume all risks, express or implied, associated with all claims released above, including without limitation, all risks concerning entry into and participation in the Contest; and (4) that neither Sponsor, nor any of the RELEASED PARTIES, have made or are responsible or liable for any warranty, expressed or implied, relative to a prize, including, but not limited to, its quality or fitness or merchantability, and all prizes are tendered to entrants on an “as is” basis. There are no warranties that extend beyond the description OF ANY PRIZE on the face of any contest materials.

    Sponsor reserves the right, in its sole discretion, to suspend, modify or cancel the Contest if the Contest cannot be run as originally planned for any reason, including, but not limited to, as the result of tampering or infection by computer virus, bugs, fraud, non-authorized human intervention, strike, lockout, or other labor dispute, national emergency, war (whether or not declared), terrorist attack, floods, accidents, epidemics, earthquakes, weather-related issues (including snowstorms and/or thunderstorms) or other causes beyond the control of Sponsor. If, in the judgment of Sponsor, the Contest is compromised as set forth herein, Sponsor reserves the right to conduct the Contest from among all eligible entries received, if any, prior to the date on which the event that compromised the Contest occurred. Sponsor further reserves the right to take whatever action it deems necessary or appropriate in connection with the administration of the Contest. Notice of cancellation / termination / modification / suspension of the Contest will be posted on the Site.

    Should a contestant be unable to attend the Finals for any reason, including the occurrence of any event described above, Sponsor will not be held responsible and will not award or compensate such contestant for lost time, wages, fees, travel expenses or costs of any kind spent in preparation for such contestant's travel to, or arrival in, New York City, and/or the value of any prizes that may have been awarded.

    Failure to comply with the Official Rules will result in disqualification. An entrant’s Entry will be disqualified, at the sole discretion of Sponsor, if he or she attempts to (a) enter the Contest through any means other than described in these Official Rules; or (b) disrupt the Contest, circumvent the terms and conditions of these Official Rules, or in any way tamper with any component of the Contest.

    In the event of any dispute concerning the identity of a nominator or nominee, the applicable Entry will be deemed submitted by the natural person who is the authorized account holder of the applicable e-mail account identified on the Official Entry Form. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

    In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Contest material (e.g., marketing, advertising, applicable Terms of Use or other ancillary information) and the terms and conditions of theseOfficial Rules,these Official Rules shall prevail, govern and control.

  7. OFFICIAL RULES/WINNER'S LIST: For the names of the contestants and winners, available after December 9, 2011, and/or a copy of the Official Rules, send a self-addressed, stamped #10 envelope to: Scotch® Brand Most Gifted Wrapper Contest, “Rules” or “Contestants/Winners List” (specify which), c/o Hunter Public Relations, 41 Madison Avenue, 5th Floor, New York, NY 10010, no later than December 31, 2011. Vermont residents may omit return postage.
