The Scotch® Brand Most Gifted Wrapper Contest

Official Rules

NO PURCHASE NECESSARY.  A purchase will not improve your chances of winning.
The Scotch® Brand Most Gifted Wrapper Contest (the “Contest”) is sponsored by 3M Stationery and Office Supplies Division (“Sponsor”).  The Contest begins at 12:01 AM Eastern Daylight Time (EDT) July 10, 2013, and ends at 11:59 PM Eastern Daylight Time (EDT) September 22, 2013 (the “Contest Period”).  CONTEST VOID IN ALASKA AND HAWAII AND WHERE PROHIBITED BY LAW.  Odds of winning depend on the number of eligible entries received.  Sponsor’s computer is the official time-keeping device for the Contest.

ELIGIBILITY:
Nominators: An eligible individual as described herein is referred to as a “Nominator.” To be eligible to nominate yourself or someone else, you must be age 18 or at least the age of the majority in their state (19 in NE and AL) on July 10, 2013, and a legal U.S. resident residing in one of the 48 contiguous United States or Washington, D.C.  Employees of Sponsor, its affiliates, subsidiaries, advertising and promotion agencies – including, without limitation, those involved in the administration, execution and judging of the Contest – and their immediate families (parents, children, siblings, spouse) and members of their same households (whether related or not) are not eligible to nominate.

Entrants: An eligible individual as described herein is referred to as an “Entrant.” To be eligible, Entrants must be legal U.S. residents residing in one of the 48 contiguous United States or Washington, D.C., and age 18 or at least the age of the majority in their state (19 in NE and AL) , as of July 10, 2013.  Any gift wrapper, either amateur (i.e. those with no employment experience as gift wrappers) or professional (i.e. those who are currently employed as or have previously earned income as gift wrappers at department stores, specialty stores, etc.), is eligible to participate. Entries from all gift wrappers will be weighted equally. Employees of Sponsor, its affiliates, subsidiaries, advertising and promotion agencies – including, without limitation, those involved in the administration, execution and judging of the Contest – and their immediate families (parents, children, siblings, spouse) and members of their same households (whether related or not) are not eligible to enter. All past contestants who competed in any of the previous Scotch® Brand Most Gifted Wrapper Contest finals are not eligible to participate.

Entrants selected as contestants for the finals of the Contest (the “Finals”) must be able to travel to New York City between December 5, 2013, through and including December 8, 2013.  If an Entrant is selected as a contestant for the Finals and cannot travel during this time, he or she will be disqualified and an alternate contestant may be selected.

HOW TO ENTER:  During the Contest Period, to enter the Contest, Nominator or prospective Entrant must go online to www.MostGiftedWrapper.com (“Site”) and accurately and truthfully complete all mandatory elements of the Official Entry Form, including, but not limited to:
Nominators:

  • Nominators may complete an online form through www.MostGiftedWrapper.com to email a potential Entrant information about entering the Contest. Nominator’s complete name and e-mail address must be provided, as well as the potential Entrant’s complete name and email address (this information will only be used with respect to the Contest and to provide you with information about Sponsor products in accordance with Sponsor’s privacy policy found at www.3m.com/privacy.jhtml).
  • Nominators are eligible for the prize outlined below should the person he/she nominates enter the Contest and become the Grand Prize winner.
  • Nominators may nominate multiple potential entrants. Nominator prize to be awarded only if the Grand Prize winner names a nominator who completed the online form prior to entrant’s entry submission date. Entrants must include the name and e-mail address of their nominator, if applicable.
  • Completing and submitting the online Nominator form does not count as an Entry into the Contest.

Entrants:

    • Entrant’s complete name, company/place of employment (include places the Entrant has previously wrapped or is currently wrapping gifts, if applicable) home address, city, state, zip code, daytime telephone number, nominator name and contact info (if applicable) and e-mail address must be provided. If entrant learned about the contest via an e-mail sent from a nominator through www.MostGiftedWrapper.com prior to entry, the entrant must provide the name and e-mail address of said nominator (this information will only be used with respect to the Contest and to provide you with information about Sponsor products in accordance with Sponsor’s privacy policy found at www.3m.com/privacy.jhtml).
    • Create an original video of 3 minutes or less describing why you, the Entrant, believe you have the gift-wrapping skills it takes to participate in the Contest. In the video, Entrants must:
      • Explain why he/she is America’s Most Gifted Wrapper and has the gift wrapping skills to participate in the contest
      • Display at least one (1) gift(s) that he/she has personally wrapped either in or out of the box
      • Provide at least one (1) gift wrapping tip
      • If an entrant is not already a registered YouTube or Google account holder, he/she must visit www.YouTube.com (the “YouTube Site”) and register for a free user account. Once registered, visit the YouTube Site and follow the instructions to upload the Video in accordance with all guidelines and restrictions (e.g., content and technical) within the allotted time period. For avoidance of doubt, Videos must comply with the formatting, size, content, consent and release, and other related requirements set forth in the YouTube Terms of Use (http://www.youtube.com/t/terms) and account holders must comply with YouTube’s Terms of Service (http://www.youtube.com/static?gl=US&template=terms). The video must live on the Entrant’s personal YouTube page through December 31, 2013. The contestant may produce and upload the video in any of YouTube’s approved formats (see http://bit.ly/HR50vI for additional information on formats that YouTube supports). Inclusion of Scotch® Brand products in the video are not necessary and will not influence the opinion of the judges. Any video that is over 3 minutes in length is subject to disqualification. (collectively, the above materials referred to in these Official Rules individually as an “Entry”; collectively, as “Entries”).

ADDITIONAL REQUIREMENTS OF ENTRY: To be eligible for the Contest and prize award, an Entry must meet, and each Entrant hereby warrants by submission of his/her Entry the truthfulness and accuracy of, the following additional requirements:

  • That the video will be original and feature the Entrant; a video featuring a gift-wrapping team or a group is ineligible.
  • The Entrant must have permission to use the name and likeness for any additional person that appears in the video. Outside persons in the video, if any, cannot assist in gift-wrapping or provide gift-wrapping tips.
  • Excluding Scotch® Brand logos, the Entry will not depict any third-party intellectual property (NO logos, trademarks, images, or contributions by others).  Scotch® Brand logos in the video are permitted, but not a condition of entry.
  • The Entry will not depict any person, place, thing, Sponsor or its products and services unfavorably, and will be suitable for all ages and for replication/display, as specified in these Official Rules or on the Website; Videos that contain vulgarity, inappropriate language, weapons or outside branding or labels of any kind will be disqualified.
  • Entries cannot be promoted by the Entrant in traditional media or though social media channels other than YouTube, including, but not limited to: Facebook, Twitter, Instagram, Pinterest, personal blogs and MySpace unless approved by the Sponsor.
  • If chosen as a finalist, Entrant will be required to provide the file for his/her video entry in the format that was submitted via YouTube when requested.
  • If not chosen as a finalist, Sponsor has the right to request the video entry file in the format that was submitted via YouTube through December 31, 2013.
  • Each Entrant agrees to participate in scheduled public relations/media activities, including but not limited to: on-site, in-studio, telephone and e-mail media interviews, media appearances prior to, during and after the selection of the winning Entries, if requested to do so by Sponsor.

Limit one entry per person, household or email address.  Entries cannot be revised or altered once submitted. Neither Sponsor nor its agents will be responsible for technical malfunctions, inability to access the Site or for lost, late, scrambled, jumbled, destroyed, delayed, misdirected, stolen, or delayed Entries and neither Sponsor nor its agents assumes responsibility for any error, omission, interruption, deletion, defect, delays in operation or transmission, theft or destruction or unauthorized access to, or alteration of, Entries. No incoherent, unoriginal, illegible, inaccurate or incomplete Entries will be accepted, and Sponsor reserves the right to reject or disqualify any Entries that it deems inappropriate, in its sole and absolute discretion, including for references to violence, sex, illegal or inappropriate activity.

Neither Sponsor nor its agents will be responsible for any problems or technical malfunctions of any telephone network or telephone lines, computer on-line systems, YouTube, servers or providers, computer equipment, software, video tape or equipment, failures in transmission of Entries or other problems (whether due to technical problems, human error or traffic congestion (or any combination thereof)), including any injury or damage to a person's computer arising out of, relating to or resulting from this Contest. Confirmation of receipt of Entries will not be provided.

Submission of Entries grants Sponsor and its agents the right to publish, use, edit, adapt, modify and/or exploit such Entries, or any portion thereof, in any way, in any and all media, whether now known or hereafter developed, without limitation and without notice, compensation or other consideration (except where prohibited by law), and constitutes the irrevocable assignment and transfer to Sponsor of any and all right, title and interest in and to such Entries, including, without limitation, all copyrights and any renewals and extensions thereof.  Upon Sponsor’s request, Entrants will execute any documents necessary to effectuate such ownership.

Entries will be preliminarily (and at any time, may subsequently be) screened for conformity with these Official Rules, including any written verification/documentation confirming the requirements and permissions specified herein requested by Sponsor in its reasonable discretion and thereafter may be posted in a photo gallery (“Gallery”) on the Website.  No correspondence regarding the screening, verification or judging status of Entries will be undertaken by Sponsor.  Incomplete, unintelligible Entries and Entries that do not fully comply with all of the requirements set forth herein will be disqualified. Limit one (1) Entry per person, household or email address.  Without limiting anything set out elsewhere in these Official Rules, certain entries may be used by Sponsor and its agents for socializing and promotion purposes during the Contest Period without notice, compensation or other consideration (except where prohibited by law).. Use of an entry for socializing and/or promotional purposes is unrelated to the judging and does not imply or guarantee selection as a finalist or prize winner in the Contest.  Entries will not be acknowledged or returned.  Proof of submitting an Entry will not be deemed proof of receipt by Sponsor. All entries become the property of the Sponsor. Sponsor reserves the right to use and/or modify the entries worldwide and into perpetuity without additional compensation or notice.

JUDGING:
Round 1: PRELIMINARY JUDGING: Eight contestants will be selected from all eligible Entries to participate in the Finals, scheduled to take place in New York City on or about Friday, December 6, 2013.  The eight contestants will be selected no later than Wednesday, October 16, 2013 by a qualified panel of judges whose decisions are final.  Entries will be judged on three criteria:

  • Appearance of wrapped item in the video (40%),
  • Enthusiasm and passion displayed toward gift-wrapping in the video (40%)
  • Gift-wrapping tip (20%).

The eight contestants will be notified via phone, e-mail or Federal Express on or around October 16, 2013.  Each contestant must sign and return any required Affidavit of Eligibility/Release of Liability and Publicity within seven (7) days of delivery to such contestant’s address as identified on the Official Entry Form (“Contestant’s Address”). Non-compliance within this time period will result in disqualification and the possible selection of an alternate contestant. Any notification returned to Sponsor as undeliverable will result in disqualification and the possible selection of an alternate contestant.  Each contestant will also be asked to provide 2-3 photos of him/herself gift-wrapping or with gifts that he/she has wrapped. Each contestant must e-mail the photos to Hunter Public Relations (“Hunter PR”) in accordance with the directions and within the seven (7) day time period provided. Non-compliance may result in disqualification and the possible selection of an alternate contestant. Photos will become part of Entries.  All additional photos submitted must comply with the “Additional Requirements of Entry” section above.

Round 2: FINAL INDEPENDENT JUDGING: The Finals consists of three rounds, with qualifying finalists in each round individually wrapping an identical item(s).  Contestants in each round will be judged on two criteria: (1) appearance of wrapped packages (70%) and (2) gift-wrapping technique (30%). In the event of a tie, speed will serve as the tie-breaker.  All contestants will be required to use Scotch® transparent tape and other Scotch® brand products, which will be provided.

Decisions of the judges are final in all matters relating to the Contest and are not subject to review or appeal.  Selection of the Grand Prize Winner will be announced at the end of the Finals as well as announced via a national press release after the selection.  All federal, state, and local laws and regulations apply.  Without limiting anything set out in these Official Rules, acceptance of prizes constitutes permission to use each contestant’s name, image/ likeness, photograph, voice and/or biographical material in advertising and promotional activities without notice, compensation or other consideration (except where prohibited by law).

PRIZES: One (1) Grand Prize: $10,000 check made payable to the Grand Prize winner.  Seven (7) runners-up prizes worth a total of $4,500, allocated as follows:

  • $2,500 for the Round Three finalist.
  • A $500 American Express® Gift Card for each of the two (2) Round Two finalists.
  • A $250 American Express® Gift Card for each of the four (4) Round One finalists.

One (1) Nominator Prize (to be awarded only if the Grand Prize winner names a nominator who completed the online form prior to entrant’s entry submission date): $500.00 check made payable to the person who nominated the Grand Prize Winner.  If more than one person nominated the Grand Prize winner, the person who the Grand Prize winner named as their nominator in his/her Entry will be eligible to win the $500.00 Nominator Prize.

In addition to the above, each of the eight (8) contestants will receive a round trip coach class airline ticket for one to New York City on or around Thursday, December 5, 2013, to participate in the Finals, departing from the major commercial airport nearest the contestant’s home and utilizing Sponsor's carrier of choice.  Stopover trips are not allowed.  Standard single room accommodations for 3 days/3 nights will be provided by Sponsor at Sponsor’s hotel of choice.  Sponsor will reimburse each contestant for the purchase of meals while in New York City for the Finals in an amount not to exceed two hundred dollars ($200), provided that appropriate receipts documenting the amounts spent are received by Hunter PR no later than December 20, 2013.  Arranging ground transportation to and from each contestant's home and the airport, to and from the airport and hotel, and from hotel back to the airport, will be the responsibility of the contestants, but Sponsor will reimburse each contestant for the actual transportation costs incurred in an amount not to exceed two hundred dollars ($200), provided that appropriate receipts documenting the amounts spent are received by Hunter PR no later than December 20, 2013. Each contestant is solely responsible for all expenses, costs and fees associated with attendance at the Finals and/or acceptance of a prize not specified herein as being provided, including, without limitation, any and all taxes, gratuities, and personal purchases/souvenirs. Each contestant shall cooperate with Sponsor with respect to any applicable federal, state or local tax reporting requirements related to the prizes or other consideration received by the contestant. Each contestant is solely responsible for reporting and paying any and all applicable federal, state and local taxes and any additional fees associated with prizes.

Special Offer: The first 50 people who submit their qualified Entry during the Entry Phase will receive an assortment of new Scotch® Expressions Tapes (ARV: $50). Limit: One (1) Special Offer per person.

Approximate retail value (“ARV”) of each contestant prize package (including the travel and meal expenses set out above) is between $2,000 and $11,850, depending on whether a contestant is the Grand Prize winner or a Round Three, Round Two or Round One semi-finalist.  Total ARV of all prizes is $28,600 ($28,100 if the Grand Prize winner is self-nominated). Actual value of Grand Prize may vary based on travel expenses.  Any difference between stated value and actual value will not be awarded.

Sponsor reserves the right, in its sole discretion, to substitute a prize or prizes of equal or greater value for any and all prizes.  No other substitutions, cash equivalents or transfer of prizes allowed unless specifically authorized by Sponsor.  All properly claimed prizes will be awarded. In the event an awarded prize has been lost, Sponsor is not responsible for a replacement.

GENERAL CONDITIONS: By entering the Contest, each Entrant, on behalf of himself/herself, and his/her executors and heirs, agrees (a) to be bound and abide by these Official Rules and by all decisions of Sponsor, whose decisions are final and binding and not open to appeal; (b) to release, indemnify, defend and hold harmless Sponsor, Hunter Public Relations, and each of its and their parents, subsidiaries, affiliates, members, shareholders, agents, representatives, employees, suppliers, agencies, successors, assigns, licensors, advertising or promotional agencies and any prize-sponsoring agency (collectively, "Released Parties"), from any and all liability whatsoever in connection with or related to this Contest, including, without limitation, from any and all causes of action, liabilities, suits, claims (including but not limited to, third party claims that may be made against Entrant, and claims arising out of or relating to acceptance, receipt, possession or use/misuse of any prize, or any publicity or other public exposure of Entrant, including without limitation, claims concerning infringement or invasion of Entrant's privacy or publicity rights, or defamation, or acts undertaken in preparation for, or participation in, the Contest), cross-claims or counterclaims, costs, injuries, losses or damages or demands of any kind (including without limitation personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light) (collectively, "Claims"), WHETHER OR NOT ARISING FROM THE NEGLIGENCE OF A RELEASED PARTY; (c) that he/she has no right to bring, and covenants not to bring, any claim, action, or proceeding of any kind or nature whatsoever against the Released Parties; (d) to assume all risks, express or implied, associated with all Claims released above, including without limitation, all risks concerning entry into and participation in the Contest; and (e) that NONE OF THE RELEASED PARTIES HAVE MADE OR MAKE OR ARE RESPONSIBLE OR LIABLE FOR ANY WARRANTY, REPRESENTATION OR GUARANTEE, EXPRESS OR IMPLIED, RELATIVE TO THIS CONTEST OR A PRIZE, AND ALL PRIZES ARE TENDERED TO ENTRANTS ON AN "AS IS" BASIS.  THERE ARE NO WARRANTIES THAT EXTEND BEYOND THE DESCRIPTION ON THE FACE OF ANY PROMOTION MATERIALS OR ANY PRIZE.

Should a contestant be unable to attend the Finals for any reason, including the occurrence of any event described below, Sponsor will not be held responsible and will not award or compensate such contestant for lost time, wages, fees, travel expenses or costs of any kind spent in preparation for such contestant's travel to, or arrival in, New York City, and/or the value of any prizes that may have been awarded. 

In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any promotion materials and the terms and conditions of these Official Rules, these Official Rules shall prevail, govern and control.
Repetitive automated electronic submission of entries of any kind are prohibited, and any such entries will be disqualified. If more than one Entry per person and e-mail address is submitted, the Entry with the earliest delivery date, as determined by Sponsor, will be accepted, and subsequent Entries will be disqualified.

Without limiting anything set forth elsewhere in these Official Rules, in case of any dispute, entries will be deemed submitted by the Authorized Account Holder of the email account specified on the Entry.  "Authorized Account Holder" is defined as the natural person who is in control of the email address specified on the Entry.  Any Entrant may be required to provide Sponsor with proof that he/she is the Authorized Account Holder of the email account associated with his/her Entry.  An Entrant’s Entry will be disqualified, at the sole discretion of Sponsor, if he/she attempts to (a) enter the Contest through any means other than described in these Official Rules; or (b) disrupt the Contest, circumvent the terms and conditions of these Official Rules, or in any way tamper with any component of the Contest.  Notwithstanding anything to the contrary contained in these Official Rules, Sponsor further reserves the right, in its sole discretion, to suspend, modify or cancel the Contest, or any portion thereof, if it cannot be run as originally planned, including by reason of tampering, unauthorized intervention or fraud; infection by computer virus; malicious software attacks, bugs, fraud, non-authorized human intervention, strike, lockout, or other labor dispute, national emergency, war (whether or not declared), terrorist attack, floods, accidents, epidemics, earthquakes, weather-related issues (including hurricanes, snowstorms and/or thunderstorms) or other causes beyond the control of Sponsor.  Sponsor further reserves the right to take whatever action it deems necessary or appropriate in connection with the administration of the Contest. Notice of cancellation/termination/modification/suspension of the Contest will be posted on www.MostGiftedWrapper.com.
Except where prohibited and subject to the releases and other provisions of these Official Rules, each Entrant: (1) agrees that any and all disputes, claims and causes of action arising out of or connected with the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by state or federal courts situated in St. Paul, Minnesota; (2) agrees that any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred and in no event shall include attorneys' fees associated with participation in the Contest; (3) agrees that no indirect, punitive, incidental, special, consequential or other damages, including without limitation, lost profits, may be awarded (collectively, "Special Damages"); and (4) waives all rights to claim Special Damages and all rights to have such damages multiplied or increased.  SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO A PARTICULAR ENTRANT(S).
The Contest and these Official Rules are governed by the laws of the State of New York, without regard to its conflicts of law rules.
CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING WITHOUT LIMITATION ATTORNEYS' FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION.

OFFICIAL RULES: These Official Rules will be posted at www.MostGiftedWrapper.com. Individuals may request a hard copy of these Official Rules by sending a self-addressed, stamped #10 envelope to: Most Gifted Wrapper Official Rules, c/o Hunter Public Relations, 41 Madison Ave., 5th floor, New York, NY 10010.  Requests for Official Rules must be postmarked by December 31, 2013.  Vermont residents may omit return postage.

WINNERS:  For the names of the contestants and winners, available after December 9, 2013, send a self-addressed, stamped #10 envelope to: Scotch® Brand Most Gifted Wrapper Contest, Contestants/Winners List (specify which), c/o Hunter Public Relations, 41 Madison Avenue, 5th Floor, New York, NY 10010, no later than December 31, 2013.   Vermont residents may omit return postage.

Copyright Infringement Notification under the DMCA
To file a copyright infringement notification with 3M under the DMCA, you, as the complaining party (the “Complaining Party”) must send a written notice to the designated agent identified below containing substantially the following information.

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

  • A statement that the Complaining Party has a good faith belief that use of the particular Content in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that the Complaining Party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Counter Notification
To file a counter notification with 3M under the DMCA, you, as the alleged infringer (the “Alleged Infringer”)” must send a written notice containing substantially the following information.

  • A physical or electronic signature of the Alleged Infringer.
  • Identification of the particular Content that has been removed or to which access has been disabled and the location before removal.
  • A statement under penalty of perjury that the Alleged Infringer has a good faith belief that the particular Content was removed or disabled as a result of mistake or misidentification of the Content to be removed or disabled.
  • The Alleged Infringer’s name, address, and telephone number, and a statement that the Alleged Infringer consents to the jurisdiction of Federal District Court for the judicial district in which the address is located, or if the Alleged Infringer’s address is outside of the United States, for any judicial district in which 3M may be found, and that the Alleged Infringer will accept service of process from the Complaining Party who provided notification under Section 512(c)(1)(C) of Title 17 of the United States Code or an agent of such person.
